Consumer Health Data Privacy Policy

This Consumer Health Data Privacy Policy (“Consumer Health Data Privacy Policy”) supplements the information in the Tempus Privacy Policy.  It applies to Washington consumers who interact with us and applies to personal information defined as “consumer health data” subject to the Washington My Health My Data Act and individuals who may be deemed consumers under applicable U.S. state privacy laws.

What Does This Consumer Health Data Privacy Policy Cover?

This Consumer Health Data Privacy Policy describes what consumer health data we collect, how we collect and use it, who we disclose it to and why, and the choices you may have regarding our use or disclosure of your consumer health data. This Consumer Health Data Privacy Policy only applies to consumer health data, which is a subset of personal information that identifies your past, present, or future physical or mental health status. Examples of consumer health data are provided below.

What Is Not Covered in This Consumer Health Data Privacy Policy?

This Consumer Health Data Privacy Policy does not apply to any personal information other than consumer health data subject to the Washington My Health My Data Act or other applicable U.S. state privacy laws. Consumer health data does not include information generated by your interactions with us, such as browsing or purchasing, that does not identify your health status.  Consumer health data also does not include publicly available information, protected health information subject to HIPAA, or personal information that has been deidentified data is not consumer health data. To the extent we process de-identified information, we will maintain and use the information in de-identified form and will not attempt to re-identify the information unless permitted by applicable law.

What Categories of Consumer Health Data Do We Collect?

Tempus may collect the following categories of Consumer Health Data about Consumers:

  • Individual health condition, treatment, disease, or diagnosis information;
  • Social, psychological, behavioral, and medical intervention information;
  • Health-related surgery or procedure information;
  • Use or purchase of prescribed medication information;
  • Bodily function, vital sign, symptoms, or measurement of physical or mental health status information;
  • Diagnosis or diagnostic testing, treatment, or medication information;
  • Precise Location Information that could reasonably indicate a Consumer’s attempt to acquire or receive health services or supplies;
  • Data that identifies a Consumer seeking Health Care Services; and
  • Information Processed to associate or identify a Consumer with the data listed above that is derived or extrapolated from non-health information, such as proxy, derivative, inferred, or emergent data by any means, including algorithms or machine learning.

How We Use Health Data

We may use this health data to serve you; to connect you with third parties; to validate your ability to access and/or use certain products, services and information; to provide and improve products and services; to protect patients and consumers; to operate, manage, and maintain our business; to respond to your inquiries and fulfill your requests; to send administrative information to you; to send you certain marketing communications; to personalize certain experiences; and to facilitate social sharing or messages services when available. We may also use your health data for our business purposes and objectives, including, data analysis; audits; developing new products; improving existing products; identifying usage trends; determining the effectiveness of promotional campaigns; preventing fraud; and expanding our business activities. Additionally, we may use this health data to comply with applicable law, legal process, respond to requests from public and government authorities, and to protect our rights, operations, and enforce our terms of service.

We primarily use your health data for these purposes in connection with providing a product or service you have requested. In some circumstances, we may collect and use health data with your consent. Additionally, we may de-identify health data so that it cannot reasonably be reidentified by us or by another person, and we may use this de-identified data for any reason permitted by applicable law. If we de identify information that was originally based on health data, we maintain and use that information in de-identified form and will not attempt to re-identify the data, except as otherwise permitted under applicable law.

How We Disclose your Health Data

 

We may share these categories of health data with third parties, such as other companies and individuals we retain to perform services on our behalf and other companies and individuals with whom we collaborate with respect to particular products or services (collectively “Providers”) and our affiliates, as described in Privacy Policy. We may also disclose health data in connection with a business transfer (such as selling or buying a business unit), to comply with the law, or to protect the safety, rights, or property of our customers, the public, Tempus or others.

Individual Rights. You may have certain rights relating to your health data subject to certain exceptions and depending on where you live. These rights may include obtaining access to and deleting your health data.

Submitting Requests. You may submit requests to exercise these rights by sending an email to privacy@tempus.com. You may be asked to provide certain personal information when submitting your request including your first and last name, email address, and telephone number for us to determine if your information is in our systems. 

Appeals. You may have a right to appeal against a decision we make relating to requests to exercise your rights under applicable local law. To appeal a decision, please email privacy@tempus.com.
